Andrew Bostian, AM Andrew Bostian joined Economic Consulting Services, LLC (“ECS”) in 2002 as a Research Assistant. Prior to joining ECS, Mr. Bostian was a student at Lafayette College where he earned his Bachelors Degree in the field of Economics and Business. In his current position as Senior Economist, he performs a variety of economic and statistical analysis work, primarily in the field of international transfer pricing and business valuation. He has also worked on projects in all of the major specialty areas at ECS, including antidumping and countervailing duty investigations and reviews. Mr. Bostian has been directly involved in the area of international transfer pricing, where he has assisted in issues involving the transfer of tangible property, intangible property, royalties and services. He is responsible for developing the data needed to derive arm’s length intercompany prices and for conducting thorough analyses of company financial information. He has worked closely with clients in preparing Section 6662 documentation reports to verify their transfer pricing systems. He has also prepared non-US transfer pricing documentation studies designed to comply with the requirements of foreign tax authorities (e.g., Canada, Mexico, and European Union countries) and the guidelines of the Organization for Economic Cooperation and Development. In addition, he has prepared written reports for use by taxpayers at the audit stage and in support of Advance Pricing Agreements. As part of Mr. Bostian’s transfer pricing work, he has conducted many CUT analyses to show that the royalty rates charged in the client’s licenses among related affiliates are at arm’s length. He has also performed numerous CPM analyses in which the client’s profitability is compared with the profits earned by similar comparables. His international transfer pricing projects have spanned many industries, services and products, including the food and beverage industries, the semiconductor industry, research and development services, market consulting services and fresh cut flowers. Mr. Bostian is also well versed in business valuations. He is an Accredited Member (AM) of the American Society of Appraisers. In the business valuation area of ECS’ practice, Mr. Bostian has primarily been involved in intangible asset appraisals, namely trademarks. Most of these appraisals are transfer pricing oriented, involving the transfer of ownership of intangible property (such as trademarks, customer lists, technology, know-how, etc.), from one affiliate to another. He has also valued whole businesses for the purposes of corporate restructuring. Mr. Bostian has also worked on antidumping and countervailing duty investigations and reviews conducted by the U.S. Department of Commerce on behalf of both petitioners and respondents. He has assisted in developing the sales and cost of production data in order to meet the data requirements of the Department of Commerce, using his background in SAS statistical programming and financial accounting.
